By proceeding with the listing of your Property, you agree to the following terms and conditions:
The service is provided by Hospitality Analsysts Pty Ltd ACN 28 143 256 491 and referred to as “WE“, “US” in these terms and conditions.
1. RoomClick Booking Service provides a listing service to facilitate referral of prospective users to your business.
2. The service provider must accurately present their services in their listing.
3. Service providers offering services that are deemed by us to be offensive or illegal will not be listed.
4. Accuracy of the data setup by the service provider is their sole responsibility and we will not be liable for any errors or omissions.
5. Time is of the essence and any request by a service provider will be actioned by us as quickly as practical.
6. Service providers can cancel their listing at any time by giving 7 day’s notice of their request to cancel.
7. A refund will be paid to the service provider for any unexpired term on a pro rata basis after allowing a processing fee of $55.00.
8. Uptime and response times are governed by our hosting supplier, which offer a 99.9% success rate. we will not be held liable for any outages.
9. User reviews are not made visible to other users, other than the sum of the feedback survey results.
10. User review survey results are refreshed every 3 months.
11. Results display on the search page are based on Top Spot first, for the next 5 positions, then, total cost of your listing and then survey results.
12. RoomClick Booking Service utilise the services of independent sales agents known as Best Local Services listing agents. The listing agents receive a commission based on your total cost and a commission on any Top Spot sales.
13. Listing agents have no authority to commit us to any agreement to provide the service provider with any benefit not disclosed in these terms and conditions.
14. We may from time to time offer incentives to service providers to utilize our services. any such agreement will be in writing and authorized by the founder of RoomClick Booking Service.
15. In the event the service provider does not make payment of the total costs and any further costs for Top Spot, within the time specified, we may terminate your listing by giving you 7 day’s notice.
16. We will use our best endeavors to drive traffic to the website, however, we do not warrant any minimum traffic volumes or search results for your services.
17. You can only list services for business activities covered by your ABN, you have no authority to list 3rd party businesses under your listing. Breaching this term will result in immediate cancellation and you will forfeit any unexpired term refund due to you.
18. We do not participate in any dealings with your users feedback, we act purely as a communication channel.
19. We do not make referral recommendations to users, other than as disclosed in these terms and conditions.
20. From time to time we may provide feedback to you to assist you in maximizing your search results. Such feedback will be general in nature and does not constitute professional advice.
21. By you clicking to accept these terms and conditions, you confirm you have legal authority to commit the ABN owner of the service provider to the costs, terms and conditions.
22. In the event any term or condition is deemed to be not valid or unenforceable, then that term will be removed and the agreement will continue to be validly enforceable.
23. Any dispute will be governed by the laws of New South Wales.
